If you’ve ever considered creating content about your TonalⓇ trainer - whether it’s video, audio, or otherwise - we’ve created these guidelines to help explain permissible use of our brand assets, and to act as a friendly reminder about respecting our (and other’s) intellectual property rights. While we love seeing love for Tonal, we value our intellectual property and reserve all our rights, including the right to take action as necessary to protect our brand.
If you’re considering using our company name, brand, trademarks, logos, product names, product images, or other branding elements (collectively, “Tonal Assets”), please review the following non-exhaustive guidelines that outline the use of Tonal Assets and other Tonal proprietary products:
The Tonal name, logos, affiliate properties, designs, trademarks, service marks and trade dress including but not limited to TONAL, BE YOUR STRONGEST, and any associated logos (collectively, “Tonal Trademarks”) are the exclusive property of Tonal and/or its affiliates, whether registered or unregistered, and may not be used in connection with any product or service that is not ours.
Nothing in the Tonal Service, Tonal Terms of Service, Tonal Terms of Sale, these guidelines, or otherwise, shall be construed as granting any license or right to use any of Tonal Trademarks or other Tonal intellectual property without our express prior written consent.
Only Tonal and its authorized licensees may use Tonal Assets, Trademarks, or other Tonal intellectual property in advertising, marketing, or promotional materials, or in any materials used for a commercial purpose. Any such use shall be governed by the terms of an agreement between Tonal and its authorized licensee.
Unless you have an appropriate written agreement with us, you may not produce, manufacture, sell or resell merchandise, products or services incorporating any Tonal Assets, Tonal Trademarks or any other Tonal intellectual property, including but not limited to apparel (e.g., t-shirts, pants, etc.), merchandise (e.g., bags, bottles, etc.), parts, accessories or other items.
Tonal Assets and/or Tonal Trademarks should never be used in the name of your business, product, service, app, domain name and/or social media account.
Any affiliation, endorsement, promotion, or sponsorship with Tonal should not be implied unless we have entered into a written agreement with you.
You must not use any trademarks, logos or other branding elements that are confusingly similar to any one or more of the Tonal Assets and/or Tonal Trademarks.
Any unauthorized or prohibited use of any Tonal Assets, Trademarks, or other Tonal intellectual property may violate intellectual property laws of the United States and other countries, and may subject you to liability for such unauthorized use. Tonal may also report your unauthorized use of Tonal Assets, Trademarks or other Tonal intellectual property to other platforms, websites or apps. As an example, Tonal may report any social media handle or post that promotes unauthorized uses of the Tonal Assets or Trademarks (like unauthorized Tonal apparel) for removal.
